Congressman Guest: SCOTUS Made Right Call; OSHA Lacks Authority to Enforce Vaccine Mandate
Washington, D.C.– Today, Congressman Michael Guest (MS-03) applauded the decision of the Supreme Court of the United States (SCOTUS) on its ruling to overturn the Occupational Safety and Health Administration’s (OSHA) federal vaccine mandate. Congressman Guest joined a bicameral group of legislators in an amicus brief supporting the arguments to overturn the vaccine mandate.
“Vaccine mandates—a prototypical state police power—are not within the purview of the OSH Act, let alone something on which Congress intended OSHA to take unilateral action under its ‘emergency’ powers. The ETS Mandate proposed by OSHA cannot stand,” the amici curiae argue.
Congressman Guest has been critical of OSHA’s overreach into public health policy and has questioned the authority of the agency to issue a nationwide vaccine mandate on certain businesses.
“OSHA does not have the authority to operate as a type of health police. I’m proud to join my colleagues in the House and Senate to fight against this Administration’s use of OSHA to burden businesses and hard-working Americans with a vaccine mandate,” Guest said in a statement on Twitter early this year.
This morning, Guest reiterated the OSHA’s lack of authority to enforce a vaccine requirement and encouraged the Supreme Court to overturn the mandate.
“OSHA does not have the authority to issue such a mandate, and it should be overturned by the court,” Guest said.
